Mobile Matters (UK) Ltd
Posted on: 22/02/2008 @ 13:02

It has come to OneCompare’s attention today that Mobile Matters (UK) Ltd have gone into administration as of the 15th February 2008. Mobile Matters (UK) Ltd are the parent company of The Mobile Outlet. We do not have any more information as yet, and are not sure of the status of The Mobile Outlet, at the time of writing the website is still up and running.

The Director of Mobile Outlet has been in the press this week to state that they have experienced problems paying out cashback to customers due to their distributors withholding commissions from them, and they are considering legal action to rectify this.

All the information that we currently have on Mobile Matters (UK) Ltd is below, we are awaiting further information and this will be posted on this thread as soon as we receive it.

Please DO NOT cancel your direct debit in response to this news. Your contract with the network and contract with Mobile Outlet are two separate contracts and canceling your direct debit will put a default on your credit reference.

We will be looking into this further and will update the forum, and our customers as soon as we have further information. If you need any further advice please do not hesitate to contact OneCompare at cashback@onecompare.com.

Hello

I shall be writing to Begbies Traynor as you suggest as unfortunately I'm another customer that TMO owe money to.

Is there any point continuing to send off bills each month as per my contract requirements or am I just wasting my money? I have had already had a letter sent by special delivery returned to me so my bills might be on their way back to me as we speak!

Thanks

Nathan

Begbies Traynor have advised customers not to send in their cashback claims to Mobile Outlet. Instead you should send your details to Begbies Traynor in writing, including your name, address and the amount of outstanding cashback you are owed.

Onecompare,
Thanks a lot for the info,
Could you just remind us who+what Begbies Traynor is please?
Also, if I'd only sent the 1st claim out of total 5 yet (for my 12-month contract), then would the "amount of outstanding cashback you are owed" you mention be as per my 1st claim only, or the total of 5 claims including 4 future claims please?
Thanks again!

Hi,

Begbies Traynor are the company who are dealing with Mobile Matters/Mobile Outlets administration.

You would put the full amount of cashback that you are owed for your entire contract, even if you have not sent in all of your cashback claims.

You will be unable to send in any further cashback claims to the Mobile Outlet, therefore Begbies Traynor need to know the full amount of cashback you are owed.

Purpose and effect of Administration
In this case, the Company has ceased trading and our primary objective is to maximise asset realisations. You should be aware that whilst in administration the Company has the protection of a wide-ranging moratorium under paragraphs 40-43 of Schedule B1 to the Insolvency Act 1986. The effect is to prevent any proceedings, execution, distraint, legal action or 'self-help'€™ remedies being commenced or continued against the Company except with the consent of the administrators or the permission of the Court.

As administrators, we are not in a position to pay amounts due by the Company in respect of contractual obligations entered into prior to our appointment. Please also send details of any contract outstanding between you and the Company.

Administrators'€™ Proposals
We are required to send you a statement of our proposals for dealing with the Company within 8 weeks of the date of our appointment. This will set out, in as much detail as necessary, our views as to how the purpose of the administration can best be achieved. We are also required to hold a meeting of creditors within 10 weeks of our appointment so that creditors have an opportunity to consider and vote on our proposals. These time limits are subject to extension by the court or for up to 28 days with the consent of creditors. We need not, however, summon a creditors’ meeting under certain circumstances, but if this is the case our proposals will provide a full explanation.

Orders for Goods and Services
Please do not fulfil any orders placed by the Company prior to our appointment unless you receive our written confirmation that the goods are still required.

Please note that the joint administrators are not personally adopting any contracts which may have been entered into by the Company, nor do we accept personal liability in respect of them.

All goods and services provided to you by the Company after our appointment must be paid for in full and no lien or set-off may be exercised against debts outstanding at the date of our appointment.

Other Matters
If you are holding any property or monies belonging to the Company would you please inform me immediately and note that you are not authorised to deal with them without my prior written confirmation. If you claim to retain title to goods delivered to the Company or a lien over assets belonging to the Company in your possession, then please contact me as soon as possible with full details and copies of any supporting documentation.

If there are any matters which you consider I should be aware of regarding the Company'€™s affairs, I shall be pleased to hear from you. This request for information is standard practice and does not imply any criticism or course of action against any person concerned in the management of the Company's affairs.

Please send details of your claim to Begbies Traynor, Burley House, 12 Clarendon Road, Leeds LS2 9NF

I have contacted my network (o2) to request a lower tarif. They refused stating that the rules are the tarif cannot be changed in the first 9 months. However during the conversation i was informed that my contract came to them from Carphone Warehouse not Mobile Outlet. What is going on here? Was my contract placed with o2 by Mobile Outlet through Carphone Warehouse? and if so why did I not know this? Also do I have any recourse with Carphone Warehouse if this is the case?

Vanilla Mobile who are Carphone Warehouses distribution arm will have been used by Mobile Outlet to fulfil your order.

Your cashback contract is with Mobile Outlet, so you would be unable to chase up any cashback payments with Carphone Warehouse as the contract was not taken out with them.

We have had customers contacting OneCompare to say that the networks have lowered their tariffs. We would suggest calling O2 again as they may have changed their stance since the last time you spoke to them.

Hi,

Called orange and managed to get a lower tariff of GBP20 p/m for the balance 6 months instead of the GBP45 p/m under Mobile Outlet's offer. However free minutes and texts are slashed by half. After doing that, I stumbled across your forum and I'd have a few questions here.

1. I'd definitely would try to write to the administrator to try to get back as much as possible. Has anybody tried written to them and if yes, can you please share the template with the rest of us. I am not very good with writing a persuasive letter.

2. Now that i managed to get a lower tariff, can I then only be able claim for the first 6 months under Mobile Outlet's offer or can I claim the balance as well under the new tariffs?

Cheers

You can't contact them because they have gone bust!
